The doctrine requires that the defendant actually saw the plaintiff in a position of peril, or that the defendant should have seen the plaintiff in a position of peril through the exercise of ordinary care, and that the defendant had sufficient time and ability to avoid the accident by the exercise of ordinary care but failed to do so.
